Nearly.AI Terms and Conditions

Thank you for choosing Nearly.AI, these terms and conditions (the "Agreement") outline the terms of use for Nearly AI (referred to as "NearlyAI," "us," "we," or "our") and govern your use of NearlyAI's services (the "Services"). By accessing or using Nearly.AI's Services, you agree to comply with and be bound by the terms and conditions set forth below. 2.2. Account Creation: To create a project of Nearly.AI, required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3. Authorised Usage: You agree to use Nearly.AI’s Services solely for lawful purposes and in compliance with all applicable laws and regulations.

  1. Payment and Billing

3.1. Fees: Usage of certain features of Nearly.AI may be subject to fees. You agree to pay all fees associated with your use of these features.

3.2. Billing: Nearly.AI may offer different payment plans. By purchasing a specific plan, you agree to the terms and conditions associated with that plan, including payment amount.

Nearly.AI Services are provided on an "as is" and "as available" basis. Nearly.AI makes no representations or warranties of any kind, whether express, implied, or statutory, regarding the Services, including but not limited to any warranties of merchantability, fitness for a particular purpose, or non-infringement.

  1. Limitation of Liability

To the fullest extent permitted by law, Nearly.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; (b) any unauthorised access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our Services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services.

  1. Changes to the Agreement

Nearly.AI reserves the right to modify this Agreement at any time. Changes will be effective immediately upon posting to the Nearly.AI website or through other means of communication. Your continued use of the Services after any such changes constitutes your acceptance of the modified terms.

  1. Governing Law and Dispute Resolution

Any disputes arising out of or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of LCIA India Arbitration Rules.
